What is mediation?

Sometimes organisations will be faced with a commercial dispute with a supplier or customer. Mediation is an easy and cost-effective way to solve this.

Mediation is a form of alternative dispute resolution (ADR): a way of settling a claim without going in front of a Judge. It’s a straightforward way to resolve a dispute. It’s not confrontational like a Court hearing where the other party’s solicitor or barrister cross examines witnesses. The parties work with the Mediator separately, and in private, over a single day to look for an acceptable solution.
At Coral Reef, we aim to have agreed an instruction within 14 days of the initial enquiry, with a date set for the Mediation as soon as possible after that.

As Mediator, we don’t take sides or determine the final outcome. By skilfully guiding both parties through their options, helping them to consider their positions, and by carefully challenging their views, we make every effort to help organisations find their own resolution.

Our legal system requires parties to a claim to consider ADR. Whilst it’s not compulsory, failing to take the opportunity can affect the way that costs are apportioned by a Court where it feels the issues could have been resolved. Some forms of contract recommend that mediation is used in the event of a dispute (for example the JCT forms of construction contract).
